There was a hearing today in the U.S. District Court for the District of Columbia in Washington, D.C. before Judge Emmet Sullivan in the case brought by Judicial Watch under the Freedom of Information Act against the Internal Revenue Service. At issue in today’s hearing were a number of emails of Lois Lerner and other IRS personnel that the IRS claims are now lost.
After today’s hearing, Judge Sullivan ordered the IRS to file a declaration with the Court under oath explaining how the emails were lost. The sworn declaration is due no later than August 10. Additionally, Judge Sullivan named a federal magistrate to determine if the lost emails can be obtained from other sources.
