Estate and business succession planning is one of the most personal services that a law firm can provide. Each family situation is unique, as are the circumstances of each family business. Putting together an estate or business succession plan requires that a client work closely with its counsel to ensure that the resulting plan is based on full and complete information and that all of the client’s objectives have been fully discussed and covered by the plan itself. As there are numerous possibilities and options that can go into an estate or business succession plan, careful review of the unique facts of each matter must be undertaken by legal counsel and client and counsel must work closely together to consider the various options available.

The various undertakings that can make up an estate or business succession plan include wills, revocable trust agreements, irrevocable trust agreements, life insurance trusts, asset protection trusts, buy-sell agreements, living wills, powers of attorney, and healthcare powers of attorney.

In addition to planning for wealth transfer at death, a complete wealth transfer or business succession plan may include lifetime wealth planning and charitable gift planning, including periodic gifting plans, charitable trusts, and private foundations.

Once an estate or trust has come into existence, representation shifts from planning to administration. Administration matters include probate of decedents’ estates, trust administration, and post-death tax planning.
